These Terms and Conditions constitute the legal framework governing the use of the platforms, applications, systems, services, and products owned by Hayhom Company For Information Technology, registered in the Kingdom of Saudi Arabia under Commercial Registration No. (2251501280).
These Terms aim to define the general provisions and regulatory controls governing the use of any of the platforms, applications, systems, services, and products of Hayhom, and to clarify the mutual rights and obligations related to browsing, usage, purchasing, or interacting with the services or products currently or in the future provided by Hayhom. The use of any of these platforms, applications, systems, services, or products constitutes explicit acceptance by the user to comply with these Terms and Conditions, in accordance with the applicable laws and regulations in the Kingdom of Saudi Arabia.
Hayhom Company For Information Technology reserves the right to amend these Terms and Conditions at any time as it deems appropriate, or in accordance with its business requirements or legal and regulatory obligations.
These Terms and Conditions apply to all users, regardless of their capacity, and to all services and products provided by Hayhom Company through its current platforms, applications, or systems, as well as any other channels it may adopt in the future. These Terms apply both within and outside the Kingdom of Saudi Arabia, unless stated otherwise.
The following words and phrases shall have the meanings assigned to them wherever they appear, unless the context requires otherwise:
• Hayhom Company / The Company: These terms refer to Hayhom Company For Information Technology, in its capacity as the owner and operator of the platforms, applications, systems, services, and products related to event and occasion management, as well as any other services or products that may be adopted by Hayhom in the future.
• User: Any natural or legal person who accesses the platforms, applications, or systems of Hayhom, or uses any of its services or products in any capacity, whether as a visitor, client, inviter, invitee, service provider, service operator, or in any other capacity.
• Client: Any natural or legal person who purchases any of the packages, services, or products provided by Hayhom through its platforms or applications, or obtains them by any means or methods that may be adopted by Hayhom in the future.
• Main Inviter: The natural or legal person who pays the financial consideration, creates the event or occasion, manages all event or occasion services, and sends electronic invitations within the scope of event and occasion management services provided by Hayhom, without having the right to access the data of additional inviters or their invitees, except for access to their general statistics.
• Additional Inviter: The person authorized by the main inviter to manage a specific number of invitations, without having the right to access the data of the main inviter, other additional inviters, their invitees, or their statistics.
• Invitee: The person who receives the electronic invitation through Hayhom’s platforms, applications, or systems, based on a request or the entry of their data by one of the inviters.
• Operator / Service Provider: Any natural or legal person authorized by Hayhom to provide operational or organizational services related to events and occasions, including but not limited to supervising halls, gates, or any other operational services assigned by Hayhom, while complying with all applicable terms, conditions, and regulations in the Kingdom of Saudi Arabia.
• Services: All operational, organizational, or technical services provided by Hayhom or delegated to third parties, including but not limited to invitation design, supervision of halls and gates, technical support, delivery, and any other services assigned within the scope of event and occasion management, in compliance with all applicable terms, conditions, and regulations in the Kingdom of Saudi Arabia.
• Products: All products provided by Hayhom through its platforms, applications, or systems, which the client may obtain or purchase through any approved means or methods that may be adopted by Hayhom in the future.
• Personal Data: Any data or information relating to an identified or identifiable individual, directly or indirectly, in accordance with the Saudi Personal Data Protection Law.
Whether the user creates an account for themselves or on behalf of a natural or legal person, they acknowledge that they possess the necessary legal capacity and authority to undertake legal actions and to use or purchase the services or products provided by Hayhom Company, and that they are legally authorized to act on their own behalf or on behalf of the person they represent.
Hayhom Company confirms that the right to use its platforms, applications, and systems is limited to those who have full legal capacity in accordance with the applicable laws and regulations in the Kingdom of Saudi Arabia. In the event that incorrect data is provided, the user, their guardian, or their legal representative shall bear full legal responsibility. Hayhom disclaims any liability for any misuse or incorrect data submitted, while reserving the right to take all necessary legal and regulatory actions upon discovering such cases.
1. Scope of Use:
The user shall use the platforms, applications, and systems of Hayhom Company for the purpose of managing and organizing events and occasions and benefiting from the supporting operational services, in accordance with the laws of Hayhom Company and the applicable laws and regulations in the Kingdom of Saudi Arabia.
2. Prohibited Use
Users of the platforms, applications, or systems of Hayhom Company are prohibited from engaging in any of the following acts or behaviors. Any violation of this section shall be considered a breach of these Terms, and Hayhom Company shall have the right to take appropriate legal and regulatory actions. The following acts and behaviors are included by way of example and not limitation:
• Entering, posting, or transmitting any content that violates the applicable laws and regulations in the Kingdom of Saudi Arabia, infringes the rights of others, or contravenes public order or public morals.
• Sending marketing, promotional, advertising, spam, or any form of unsolicited messages or invitations.
• Using or distributing bots, automated services, or any automation tools intended to manipulate, disrupt, or harm the platforms, applications, or systems of Hayhom, or to negatively affect the user experience.
• Conducting any financial or commercial transactions outside the official mechanisms of the platforms, applications, or systems of Hayhom, or attempting to bypass payment mechanisms applicable in the Kingdom of Saudi Arabia.
• Introducing, distributing, or transmitting any malicious software, including viruses, or engaging in or assisting cyberattacks, including but not limited to denial-of-service attacks.
• Any attempt to hack, breach, or gain unauthorized access to the platforms, applications, systems, or servers of Hayhom, or to bypass access controls or authentication mechanisms.
• Any attempt to extract, modify, or disclose algorithms, executable files, or internal components of the platforms, applications, or systems of Hayhom, or the use or distribution of reverse engineering tools or techniques, decompilation, decryption, reproduction of source code or parts thereof, or any action that leads to exploitation, duplication, or disclosure of trade secrets or technical know-how belonging to Hayhom, without prior written authorization.
• Creating or operating unauthorized application programming interfaces (APIs) or integrations that affect the security or integrity of Hayhom’s platforms, applications, or systems.
• Using bypass techniques such as proxies or virtual private networks (VPNs) to circumvent bans, geographical restrictions, or technical limitations, or to evade actions taken by Hayhom.
• Impersonating any person or entity, attempting to access other users’ accounts, sharing login credentials with unauthorized parties, or enabling unauthorized access to others.
• Reselling, transferring, renting, distributing, or granting access to products or services to third parties without prior written consent from Hayhom Company.
• Using the platforms, applications, or systems of Hayhom for fraudulent purposes, money laundering, financing prohibited activities, or organizing events or occasions that violate applicable laws and regulations in the Kingdom of Saudi Arabia.
• Any activity that results in disrupting services or products, harming the reputation of Hayhom, or negatively affecting the safety, reliability, or integrity of its platforms, applications, or systems, or the data of its users.
Hayhom Company shall have the right, without prejudice to its legal and regulatory rights, to remove, suspend, or restrict any content or account that violates these provisions immediately, and to take all appropriate technical and legal measures, including cooperation with competent authorities and claiming full compensation for damages.
3. Responsibility, Account, and Security
• Login Data Confidentiality
The user shall maintain the confidentiality of their login credentials, not share them with any third party, and take all necessary measures to ensure account security and prevent unauthorized access.
• Breach Notification
The user undertakes to immediately notify Hayhom Company upon discovering any hacking, unauthorized access, or any suspicious activity related to account security, and to take all necessary measures to protect and secure their account.
• Responsibility for Activities and Shared Accounts
The user bears full responsibility for all activities conducted through their account, whether authorized or resulting from insecure data usage. If the account is used by more than one person or across multiple devices, the account owner remains fully responsible for all activities, including but not limited to any violation of the Terms and Conditions or applicable laws in the Kingdom of Saudi Arabia. The user acknowledges that sharing login credentials with any third party does not absolve them of legal responsibilities or obligations arising from account usage, and Hayhom reserves the right to take all necessary legal and technical actions to protect the security and integrity of its platforms, applications, or systems.
• Content and Comments Responsibility
Any content published by the user through Hayhom’s platforms, applications, or systems, including comments or reviews, must comply with applicable laws, regulations, public morals, and third-party rights. The user is fully responsible for such content. Hayhom reserves the right to modify, delete, or block any content that violates these terms or harms its platforms, applications, or systems or their users, without any obligation to provide compensation.
Some services of the platforms, applications, or systems of Hayhom Company may include advertisements or promotional materials related to Hayhom’s services or products or those of its partners, and the display method, number, or placement of such advertisements may change from time to time without prior notice.
Hayhom Company confirms that the appearance of advertisements does not imply any sharing of personal data of users of its platforms, applications, or systems, including but not limited to clients, invitees, or any other related capacity, and no such data is used for advertising or marketing purposes in any form.
Accordingly, by using the platforms, applications, or systems of Hayhom Company, you acknowledge and agree to the possibility of displaying such general advertisements within the services or products, without any use of your personal data outside the scope of providing the agreed service or product.
1. Price Changes
Hayhom Company reserves the right to modify or update the prices of services or products at any time without prior notice. The user is responsible for monitoring the current prices displayed through the platforms, applications, or systems of Hayhom Company. The prices applicable at the time of order confirmation shall be the binding and approved prices for both parties.
2. Changes to Products and Services
Hayhom Company reserves the right to modify or update the content of services or products, including – but not limited to – adding or removing features or functionalities, at any time without prior notice. The user is responsible for monitoring the current content displayed through the platforms, applications, or systems of Hayhom Company. The content of services and products applicable at the time of order confirmation shall be the binding and approved content for both parties.
3. Approved Payment Methods
Hayhom Company provides users with its approved payment methods to complete financial transactions related to services and products offered through its platforms, applications, or systems. These methods include – but are not limited to – credit cards, Mada cards, and bank transfers.
Hayhom Company reserves the right to modify, add, or remove any of the available payment methods as it deems appropriate and in accordance with the applicable laws and regulations in the Kingdom of Saudi Arabia.
4. User Payment Responsibility
• Payment Validity and Sufficiency Guarantee
The user shall ensure that sufficient funds are available in their payment methods or that their credit limit is adequate to successfully complete the payment before confirming the order on the platforms, applications, or systems of Hayhom Company. The user is fully responsible for the accuracy of all financial data provided for any payment transaction, including – but not limited to – card numbers, validity, expiration dates, and any other required information to complete the payment in accordance with the system used by Hayhom Company or its payment service providers.
• Finality of Payments
All payments made after order confirmation are final and non-refundable, except in cases stated in the Cancellation and Postponement Policy or any other policy that may be introduced by Hayhom Company. The user acknowledges and agrees that they have no right to request any refund except as explicitly stated in such official policies.
• Fraud and Financial Manipulation Prevention
The user is strictly prohibited from engaging in any fraudulent or manipulative financial practices of any kind, including – but not limited to – unauthorized chargebacks, misuse of electronic payment methods, or attempting to exploit any technical or financial vulnerabilities within the platforms, applications, or systems of Hayhom Company.
The user acknowledges that all payment transactions related to services or products provided by Hayhom Company are conducted exclusively through its approved payment channels, which may include bank transfers, authorized payment service providers, or any other method that Hayhom Company may adopt in the future. Hayhom does not store any payment data or financial information of users.
In the event of any fraud or financial manipulation, the entity responsible for processing the payment shall handle the incident according to its own policies and procedures, and Hayhom Company shall bear no financial or legal responsibility toward the user or any third party, unless direct negligence by Hayhom is proven.
To protect its rights and ensure the safety of its platforms, applications, or systems, Hayhom Company reserves the right to take the following actions in case of suspected illegal or non-compliant financial activity, including – but not limited to – the following:
• Suspend, restrict, or block the user’s account or access to the platforms, applications, or systems of Hayhom Company.
• Reject or suspend any service request or transaction associated with a suspicious account until verification with the service provider is completed.
• Cooperate with payment service providers and competent authorities in the Kingdom of Saudi Arabia when necessary to investigate or pursue any fraudulent activity.
5. Late or Non-Payment
In the event that the user fails to pay any due amounts for services or products provided by Hayhom Company, Hayhom reserves the right to take any appropriate actions, including – but not limited to – suspending, restricting, or permanently terminating the user’s account, and deleting or disabling any related data, content, or services, without any obligation to compensate or refund any previously paid amounts.
Hayhom Company also has the right, in case of accumulated dues or repeated delays or non-payment, to take legal actions to collect such amounts, including filing claims through judicial authorities, and charging the user with all legal fees and costs incurred.
6. Service Termination
The service is automatically considered terminated upon completion or upon full consumption of the purchased services or products by the user. The user acknowledges that their use of services or products is limited strictly to what has been purchased, and Hayhom Company shall not be obligated to provide any additional unpaid services, products, or benefits not included in the purchase.
Hayhom Company reserves the right to suspend or terminate any of its services or products, in whole or in part, in the event of a violation of the Terms and Conditions or misuse of the platforms, applications, systems, services, or products in any manner, without any obligation to provide compensation.
Termination of the service – for any reason – shall result in the loss of the user’s right to benefit from the purchased services or products, without affecting Hayhom Company’s right to collect any outstanding amounts due before the termination date.
7. Agreements and Transactions Outside Platforms and Applications
Hayhom Company clarifies that all services and products are provided exclusively through its official platforms, applications, and systems, and any transactions, agreements, or payments made outside these channels, or through non-official payment methods, are solely the responsibility of the user.
Any commitment, undertaking, agreement, or promise made outside the official channels of Hayhom Company shall be considered null and void and shall not bind Hayhom Company in any way, and the user shall have no right to claim any compensation or recourse based on such arrangements.
All rights related to the platforms, applications, systems, services, and products of Hayhom Company, including but not limited to software, source code, databases, designs, logos, texts, images, digital content, algorithms, engineering models, operational models, mathematical models, operational procedures, and any materials or content developed or provided by Hayhom Company or on its behalf, are exclusively owned by Hayhom Company and are protected under the intellectual property laws in force in the Kingdom of Saudi Arabia.
The user is granted the right to use the platforms, applications, systems, services, and products of Hayhom Company strictly on a personal and non-commercial basis, including any content they add through the platforms, applications, or systems of Hayhom Company, including but not limited to texts, images, and invitee data. The user shall bear full responsibility for the legality of such content and its compliance with third-party rights, and shall assume full legal liability for any resulting consequences. The user acknowledges that using the platforms, applications, systems, services, or products of Hayhom Company does not grant any ownership rights or license to exploit Hayhom Company’s intellectual property rights, reproduce, modify, distribute, or create derivative works thereof, or use any algorithms, source code, or technical components of Hayhom Company or its associated service providers, except with prior written approval from Hayhom Company.
The user is prohibited from engaging in the following, including but not limited to:
• Reselling or sublicensing the platforms, applications, or systems of Hayhom Company or any part thereof, or any related services or products.
• Modifying or creating derivative works of the platforms, applications, or systems of Hayhom Company, or any related technical or software content.
• Attempting to gain unauthorized access to source code, algorithms, engineering models, or any technical content.
• Using any technical means to bypass Hayhom Company’s protection systems, circumvent technical or software restrictions, or unlawfully extract any software components or protected content.
• Using trademarks, logos, or any identifying elements of Hayhom Company in a way that implies a false association with the company or harms its reputation.
• Engaging in any acts that constitute unfair competition or unlawful exploitation of Hayhom Company’s technology, data, or content, including but not limited to developing similar services or products based directly on Hayhom Company’s knowledge, code, algorithms, or technical designs.
The user shall retain all copyright and intellectual property notices associated with any content, software, code, designs, or digital services provided by Hayhom Company through its platforms, applications, or systems, and shall not remove or alter any notice related to Hayhom Company’s rights, in order to ensure the protection of its intellectual and technical property rights.
Hayhom Company reserves the right to take all legal and technical measures to protect its intellectual and technical property rights, including but not limited to civil claims for damages, and taking necessary actions with competent authorities to track, prevent, and stop any infringement or unauthorized exploitation.
1. Hayhom Company Liability
Hayhom Company’s liability is limited to providing and making available its platforms, applications, systems, services, and products related to managing and organizing events and occasions and providing supporting operational services, in accordance with available technical capabilities and within the scope of what is provided to the user in its current state at the time of use.
Hayhom Company exercises the highest degree of professional and technical care commonly recognized to ensure the regular and secure operation of its platforms, applications, and systems. However, Hayhom Company does not guarantee that its products or services will be free from interruption, malfunction, delay, operational errors, programming errors, or security issues, whether caused by updates, technical failures, connectivity issues, service provider failures, emergency circumstances, force majeure, or any other reasons beyond its reasonable control.
In the event that a proven gross error or clear negligence by Hayhom Company directly causes actual and direct damage to the user, Hayhom Company’s liability shall be limited to compensation for direct damages only, to the extent legally proven, excluding any indirect, consequential, incidental, potential, or moral damages. Such liability shall in all cases be capped at the value of the service or product subject to the claim, in accordance with applicable laws and regulations in the Kingdom of Saudi Arabia and the procedures adopted by Hayhom Company.
2. Liability Exemptions
Hayhom Company shall not be liable for any direct, indirect, consequential, incidental, or moral damages or losses arising from the following cases:
• Use of or inability to use the platforms, applications, systems, products, or services of Hayhom Company, when such inability results from causes beyond Hayhom Company’s control or from the user or third parties, and not from gross negligence or clear fault by Hayhom Company.
• Any content created, uploaded, or shared by users or third parties, including invitations, tickets, images, data, designs, texts, visual materials, or any other information.
• Software errors, technical failures, connectivity issues, hacking attempts, cyberattacks, malware, network failures, or issues with external service providers, unless it is proven that Hayhom Company failed to take reasonable technical measures to prevent them.
• Any unlawful or unauthorized use of the platforms, applications, systems, products, or services of Hayhom Company by the user or any other party.
• Damages resulting from force majeure or emergency circumstances such as natural disasters, regulatory decisions, or any events beyond Hayhom Company’s reasonable control.
3. User Responsibility
The user is solely and fully responsible for the accuracy, correctness, and legality of any content they enter or provide to the platforms, applications, or systems of Hayhom Company, including but not limited to texts, images, designs, invitations, and personal data, and for full compliance with all applicable laws and regulations in the Kingdom of Saudi Arabia, including data protection laws, intellectual property rights, and public morality regulations.
The user acknowledges full responsibility for any damages or consequences arising from the content they provide to the platforms, applications, or systems of Hayhom Company, whether to themselves or to third parties, and agrees that Hayhom Company shall not bear any direct, indirect, or consequential liability beyond what is explicitly stated in these Terms and Conditions or what is explicitly required by applicable laws and regulations in the Kingdom of Saudi Arabia.
4. Operators and Service Providers
Hayhom Company shall not be held liable for any acts or omissions of its approved operators or service providers, whether financial, operational, or related to the provision, operation, or maintenance of services, including but not limited to payment providers, event-related facilities, and any other service provider that Hayhom Company may contract with in the future.
The responsibility of such operators or providers, if any, shall be limited to what is stipulated in applicable laws and contractual agreements, without any joint, vicarious, or subsidiary liability on the part of Hayhom Company toward the user for any act or omission beyond what is contractually or legally agreed.
Hayhom Company shall exercise reasonable care in selecting and monitoring service providers to ensure their competence and continuity of performance, without this being considered a guarantee of their results or the continuous availability of their services at all times.
• Hayhom Company reserves the right to amend or update these Terms and Conditions or any related policies at any time as it deems appropriate, provided that the user is notified through the official channels available on the platforms, applications, or systems, including but not limited to direct notifications within the platforms, applications, or systems of Hayhom Company. The user acknowledges that failure to receive such notifications does not affect the rights of Hayhom Company or the obligations of the user, and continued use of the platforms, applications, or systems of Hayhom Company after any amendment shall constitute explicit and binding acceptance of the amended terms.
• All policies related to the platforms, applications, or systems of Hayhom Company, including but not limited to the Privacy Policy and the Cancellation and Postponement Policy, are an integral part of these Terms and Conditions. Compliance with such policies is a fundamental requirement for using the platforms, applications, or systems of Hayhom Company, and acceptance of these policies is a condition for completing any booking, payment, or use of paid services and products.
• If any provision of these Terms and Conditions is deemed illegal or unenforceable under the applicable laws and regulations in the Kingdom of Saudi Arabia, such provision shall not affect the validity or enforceability of the remaining provisions. The invalid or unenforceable provision shall be replaced with a valid provision that closely reflects the original intent and purpose while preserving the objectives of these Terms and the rights of Hayhom Company.
• Hayhom Company shall not be liable for any failure or delay in performing its obligations due to force majeure or any emergency circumstances beyond its control, including but not limited to natural disasters, wars, technical failures, or any other events beyond its reasonable control. The user shall not be entitled to claim any compensation in such cases.
• Hayhom Company reserves the full right to take all legal, technical, and operational measures necessary to protect its interests and rights in the event of any misuse or violation of the platforms, applications, systems, services, products, or owned content, including but not limited to suspending or terminating services, and preventing any user from accessing the platforms, applications, or systems of Hayhom Company or any of its products or services, without prejudice to any rights or obligations stipulated under the applicable laws and regulations in the Kingdom of Saudi Arabia.
• The Arabic version of these Terms and Conditions shall be the official and legally binding version, and shall prevail in case of any discrepancy or conflict with any translation or other version.
• These Terms and Conditions shall be interpreted and governed in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia, and the competent courts within the Kingdom of Saudi Arabia shall have exclusive jurisdiction over any dispute or claim arising from or related to these Terms, their interpretation, or implementation.
